If your spouse has filed for a divorce against you, you do not have to lie down and take a beating without defending yourself and your legal rights. At the same time, when there are minor children and child custody issues involved, it is usually best for the parents to both work together with their lawyers and work out the custody and visitation in an amicable and agreeable fashion that is in the best interests of all involved. The courts normally take the position that they are primarily concerned with the best interests of the children, and the parents rights come in somewhat behind those of the children. If the parents are not able to work out agreements between them on the issues involving custody and child support, then the court will do it for them and either or both of the parents may or may not like the courts decision; but, they will have to live with it. If you do not get a satisfactory court order on child support in the beginning, you will have the difficult task later of proving to the court that there are substantial changes and continuing circumstances that merit the court reconsidering its previous ruling or your previous agreement to the financial aspects of your divorce, separation, or paternity situation. Usually the courts base the child support payments on the respective parents tax returns over the past 3-5 years. It is important for you to get good representation at the beginning from a lawyer and a firm that share your values and beliefs so that they understand what is important to you when it comes down to the bottom line of making agreements on custody, visitation, child support and other similar legal matters.
Paternity actions wherein the parents have a child out of wedlock have become more and more prevalent in our world today. Usually it is best for all involved for the paternity determination of who is the actual father of the newborn child to be cleared up as soon as possible after the child is born. Blood, and or DNA tests, are available now to satisfy the persons involved as to the verification and proof of the actual father of the child. The sooner that this matter is determined and the sooner that the visitation, custody, child support and healthcare arrangements can be made, it is generally better in the long run for all of those involved. Many times one of the parents wants to eliminate the other from the life of the child; but, it should be considered that the child is going to grow up some day and will normally want a relationship with both parents. Establishing a workable relationship between mother, father and child from the beginning is the ultimate goal in most situations. Of course, some situations do not lend themselves to this amicable and workable situation due to drug use or other indiscretions of a parent. These situations call for one of the parents to take special precautions that would be in the best interest presently for the safety and security of the child. If the paternity and support issues are not resolved soon after birth, a custodial parent may come to court even many years later and ask for those many years of back child support in a lump sum that maybe the other parent cannot afford at the time.
